CLARKE WILLMOTT SUCCESSFULLY DEFENDS SWINDON TOWN FC IN CLAIM FOR OVER £1M

A substantial claim against Swindon Town FC has been defeated by the Clarke Willmott sports sector team.

Proceedings were brought against the club by DATASAT Communications Limited (“DATASAT”), Mr. William Power and Mr. Phillip Emmell, in which they alleged that monies in excess of £1million paid by them to the club in 2007 should be repaid.

Originally, the proceedings, which commenced in July 2007, were principally brought against the club’s former holding company. However, these claims were amended and brought against the club after the former holding company entered into administration in March 2008. The club has vigorously defended the claims. 

Following a week-long trial in the High Court of Justice in London, judgement in this matter was delivered by Deputy Judge Mr. Gavin Kealey QC.

Clarke Willmott’s team, widely acknowledged as being in the top three sports law teams in the UK, was led out of the firm’s London office by sports partner Trevor Watkins assisted by senior associate Paolo Sidoli and associate Richard Garlick.

Mr Watkins said he was delighted for the football club.

He said: “This is excellent news for Swindon Town FC, which was facing a claim which if successful, would have demanded they find well over a further £1 million pounds plus costs. Coming on the back of it securing League One football for next season, I am delighted for Andrew Fitton and his board who have given unstinting assistance and support throughout in dealing with a claim not of their making.

“Our robust defence, coupled with our strong understanding of sport and legal principles, enabled us to demonstrate the client’s case clearly.  

“Our team took this case on just three months before it was set for trial. Given the extent of work which was needed, thoroughness and intensity of our preparation, this result highlights the level of expertise our team possesses. It was particularly seen in the work of Paolo, who led the case day to day and Richard. Simon Birt of Counsel presented the defence in court with precision, understanding of the industry and ensured the client’s case was clearly put.”

The claimants were refused leave to appeal. They were represented by Mark Davies and Oliver Cain of Davis & Co.
